Marriage Paperwork Requirements For Canadian Citizens Getting Married in Italy
In order to be married in Italy, Canadian Citizens must present a Nulla Osta (Certificate of non-impediment) to the Registry Office of the city where the wedding will take place.
The Canadian Government does not issue the Nulla Osta. However, the Canadian Embassy in Rome and the Consulate General in Milan can assist Canadian citizens in preparing a declaration containing the relevant information.
To obtain this document, you must set up an appointment with the Embassy in Rome (or the Consulate in Milan) and complete and swear an Affidavit, bringing the following documents:
- Canadian Passport
- Proof of Canadian citizenship (Canadian Birth certificate or Certificate of Canadian Citizenship)
- Document issued by the Canadian Vital Statistics Office confirming that no registration of marriage appears in their records (if obtainable)
- Complete details of the future spouse
- Final divorce decree or death certificate (if applicable)
- Parents' consent if under 18.
The affidavit can be also sworn in front of a notary public in Canada or a consular official at Canadian Embassies or Consulates in other countries. Please note that a woman whose previous marriage was terminated within the last 300 days must obtain a waiver from the competent "Procura della Repubblica" (Court) in Italy in order to marry.
The declaration issued by the Embassy or Canadian consulate must be authenticated at the "Prefettura - Ufficio Legalizzazioni".
